What a Luxembourg landlord is actually reading in your application

Rent in Luxembourg is capped, so a landlord cannot select on price. They select on the probability of being paid for three years without administration. Understanding that changes what belongs in the file and what is wasted paper.

Why the file matters more here than elsewhere

The statutory ceiling on Luxembourg residential rent is defined by the rule that the annual rent may not exceed 5% of the capital invested in the dwelling, revalued. The 2024 reform kept that rule and abolished the luxury-dwelling exemption that had allowed higher-end properties to sit outside it. The reform also clarified that where a dwelling is let to several tenants, whether under a single joint lease or under multiple individual leases, the sum of the rents is subject to the same ceiling.

The consequence for an applicant is direct. Offering more money is not available to you, and in most cases would not be lawful. Competition therefore runs entirely on credibility and on speed.

The file, in the order a landlord reads it

What to leave out: character references from friends, family photographs, and a letter about how much you loved the apartment. None of it reduces perceived risk, and each page dilutes a document that is being scanned rather than read.

The two signals that carry disproportionate weight

Contract type over salary level. An open-ended Luxembourg employment contract at a moderate salary generally reads better than a higher figure on a fixed term. What the landlord is pricing is durability, and a permanent contract with a recognisable Luxembourg employer answers that question in one line.

Completeness on first submission. A complete file beats a stronger file that arrives in three instalments, because each missing document is a reason to move to the next applicant rather than to chase you. Have the PDF on your phone before the first viewing, and send it the same day.

The convention most Luxembourg landlords and agents apply is gross monthly income of roughly three times the rent. It is a market practice rather than a legal requirement, but it is consistent enough to plan around, and knowing it lets you decide in advance whether you need a supporting structure.

When the income ratio is tight

Offering several months' rent in advance is sometimes accepted and is a weaker signal than people assume, because it can read as compensating for something. A bank guarantee lands better.

What the landlord may not ask of you

Two limits are still occasionally tested on arrivals who do not know the law changed on 1 August 2024.

The rental guarantee cannot exceed two months' rent, calculated on the base rent excluding charges. Calculating the ceiling on rent plus charges is a common and material error. Leases signed before that date remain subject to the previous three-month maximum.

Agency commission is shared equally between landlord and tenant. If you are asked for a full month plus VAT on a new lease, raise it before signing rather than afterwards.

The lease itself must be in writing on pain of nullity and must contain prescribed content, including the identity of the parties, the designation of every room and part of the building let, the address and cadastral reference, the rent and charges with the calculation method, the guarantee, the entry date, and an express statement that either party may refer a rent dispute to the commune's rent commission.

After acceptance, before you transfer

The twenty-four hours between being selected and signing are the only period in which your position is strong. Ask for the draft lease in writing and read four clauses: duration and termination, the charges advance and the method of annual reconciliation, the allocation of repairs and maintenance, and the insurance requirement.

Certain clauses are void whatever the document says, including a guarantee above the legal maximum, an unlimited continuing liability for a departed flatmate, and any clause relieving the landlord of the obligation to deliver a habitable dwelling. Meeting one of these is a reasonable trigger for having the whole contract read by a lawyer.

Three questions we are asked

Can I apply before I have a Luxembourg address? Yes, and most arrivals do. State the sequence and the expected dates explicitly, because a blank field reads as an unanswered question.

Should I negotiate the rent in my application? No. Negotiate after you have been selected, when you are one applicant rather than one of eleven.

We are two people sharing. What should we establish first? Whether the landlord is offering a single joint lease or separate individual leases. Under a joint lease the tenants are jointly and severally liable, so the landlord may pursue any one of you for the entire rent, and the rules on a flatmate's departure and on the guarantee follow that structure.

Speed, which decides more outcomes than content

A well-located apartment in Belair, Limpertsberg or Merl commonly attracts a dozen files within forty-eight hours, and the sequencing advantage is larger than most applicants realise. The file submitted during the viewing sits at the top of the pile; the same file sent the following morning sits behind four others.

Three habits make that possible. Have the PDF on your phone before the first viewing rather than assembling it after one goes well. Ask at the end of every viewing when the landlord intends to decide, which tells you whether you have hours or days. And confirm your interest in writing the same day, in two sentences, with the file attached.

A parallel point about the money. The first month of a Luxembourg tenancy typically requires the first month's rent, a guarantee of up to two months' rent, your half of the agency commission plus VAT, and the first charges advance. On a €2,400 apartment that is comfortably above €9,000 in a single transfer, and a good property will not wait five working days for an international transfer to clear. Open the Luxembourg bank account in parallel with the search, not after it. A signed employment contract is generally enough to begin the process remotely, and having the funds locally available is part of being the easy applicant rather than the risky one.
